Rickert-Finlay Covenant of 1906

First: No house shall be erected between Broadway and State Street west of the centre line of Block 21 costing less than $5000.
Second: No house shall be erected between Crocheron Avenue and State Street east of the centre line of Block 21 costing less than $4000.
Third: No house shall be erected north of State Street west of the centre line of Block 22, north of Mitchell Avenue, costing less than $4000.
Forth: No house shall be erected north of State Street, east of the centre line of Block 22, costing less than $3000.
Fifth: No house shall be erected between Crocheron Avenue and the Long Island Railroad, East of 25th Street, costing less than $4000.
Sixth: No lot or building thereon shall be used for any manufacturing or business purpose whatsoever, except in blocks 20 and 26, which shall be known herein as the “business section”.
Seventh: No building shall be erected in the “business section” having less than 2 stories above the street grade. No building shall be erected in said section unless the first story shall be of stone, brick, terra cotta or concrete construction.
Eighth: No lot or building erected thereon shall be used for the sale of liquors, except in hotels or restaurants located in the “business section”.
Ninth: No lot or building in the “business section” shall be used for any business which shall constitute a nuisance.
Tenth: No house shall be erected on a plot fronting on Broadway containing less than 5 lots, except in blocks 1 and 2.
Eleventh: No house shall be erected on a plot fronting on the Northerly side of Crocheron Avenue, East of 22nd Street, having a frontage of less than 60 feet.
Twelfth: No house shall be erected on a plot fronting on the South side of Crocheron Avenue, East of 25th Street, having a frontage of less than 60 feet.
Thirteenth: No house shall be erected on the street lots lying between Broadway and Crocheron Avenue and State Street on a plot less than 3 inside lots or a corner lot of less than 4 lots.
Fourteenth: No house shall be erected North of State Street, West of the centre line of Block 22, or in Blocks 16, 19 and 23 on a plot containing less than 3 inside lots or a corner plot of less than 4 lots.
Fifteenth: No house shall be erected North of State Street, East of the centre line of Block 22, or in Block 13 on a plot of less than 2 inside lots or a corner plot of less than 3 lots.
Sixteenth: No building of the character known as a “two family house” flat or apartment house , shall be erected except as provided in paragraph 26.
Seventeenth: No building of any character having what is known as a “flat roof” shall be erected except in the “business section”.
Eighteenth: No building shall be erected nearer than 20 feet to the front line of any lot except in the “business section” and as provided in paragraph 19.
Nineteenth: No building shall be erected fronting on 17th Street in Blocks 1 and 2 nearer than 10 feet to the front line of the lots.
Twentieth: No building shall be erected nearer than 20 feet to the side street line of any lot, except in the “business section”.
Twenty-First: No stable or other outbuilding shall be erected nearer than 60 feet to the front line of any lot, except in the “business section” and on 17th Street in Blocks 1 and 2.
Twenty-Second: No stable or other outbuilding shall be erected nearer than 40 feet to the front line of lots fronting on 17th Street in Blocks 1 and 2.
Twenty-Third: No stable or other outbuilding shall be erected nearer than 40 feet to the said street line of any lot except in the “business section” and in Block 13.
Twenty-Forth: No house except in the “business section” shall be erected to front on any street except that on which the lots front.
Twenty-Fifth: No fence except hedge or shrubbery will be permitted within 20 feet of the front line or side street line of any lot.
Twenty-Sixth: Apartment houses may be erected east of the centre line of Blocks 21 and 22 and West of the centre line of Blocks 27 and 28 on the following conditions:No single apartment house shall be erected to cost less than $4000.No double apartment house shall be erected to cost less than $6000.No apartment house shall be erected having a flat roof.No apartment house shall be erected having more than 2 apartments on a floor.No single apartment house shall be erected having a frontage of less than 20 feet.No double apartment house shall be erected having a frontage of less than 40 feet.No single or double apartment house shall be erected with less than 10 feet space between it and the nearest adjoining house.
Twenty-Seventh: The above restrictions do not apply to certain plots, included within the limits herein mentioned, but not owned or controlled by the party of the first part.
Twenty-Eighth: The foregoing covenants numbered FIRST to TWENTY-SEVENTH inclusive are covenants running with the lands and shall bind the party of the second part and the heirs or successors, assigns and grantees of the party of the second part.
